一、改革中的公证法律服务市场化定位根据国务院批转的司法部《关于深化公证工作改革的方案》,提供公证法律服务的专门机构——公证处的性质是“执行国家公证职能、自主开展业务、独立承担责任、按市场规律和自律机制运行的公益性、非营利性的事业法人”。因此,公证法律服务走向市场应是题中应有之义,似无再作争论之必要。从理论上说,公证法律服务的市场化与一般商品的市场化有着本质区别,尤其是公证处的非赢利性决定了公证处相互之间并不存在商业性质上的竞争关系。但是理论上的逻辑推理与现实中的客观存在未必是同一的。在一些改革开放的前沿城市,在把公证处定
