我国首次强制要求外国人参加社会保险,本文分析了扩大社会保险保障对象须考量的因素,提出了外国人在我国参加社会保险法律机制存在的不足,并给出了完善建议。主要为修正“在我国就业的外国人”这一概念,明确外国人参加我国社保享受国民待遇,与其他国家签订双边协定并且完善双边协定的内容,针对外国人享受我国社保待遇规定特殊条件。
For the first time in China, foreigners are forced to participate in social insurance. This article analyzes the factors that need to be considered in expanding the coverage of social insurance, puts forward the shortcomings of foreigners in our country to participate in the legal mechanism of social insurance, and gives some suggestions. Mainly for the purpose of amending the concept of “foreigners employed in our country”, specifying the conditions for foreigners to participate in social security in China, enjoying national treatment, signing bilateral agreements with other countries and perfecting bilateral agreements, and setting forth special conditions for foreigners to enjoy social security benefits in China .
