商品社会的快速发展,带来了资源、信息、人口的大范围流动、流通,直接导致不同思维理念、生活方式得以发生日益广泛的交汇融合。这一变化,带来了社会人群观念的更新演化,对传统的家庭组织形式、婚姻存续形态构成了广泛而影响深远的冲击,使得诉讼离婚率同步高企于社会经济增长。而就司法审判机关的民事诉讼审理实践来看,离婚案件和其中的公告离婚案件呈现出“双增长”的势态。简单而言,婚姻关系争议呈现出不但是通过离婚诉讼来解决,而且还是通过公告离婚的方式来解决的典型局面。本文拟就公告离婚这一特定诉讼方式的功能属性及其运用问题解决做一探讨。
The rapid development of commodity society has brought a wide range of resources, information and population flow and circulation, leading directly to the convergence of different ideas and lifestyles. This change has brought about the renewal and evolution of the concept of social groups, which has a far-reaching and widespread impact on the traditional family organization forms and forms of marriage, making the divorce rates of litigation high at the same pace as the social and economic growth. As for judicial trial organs, the cases of divorce cases and divorce cases in which divorce cases are presented show a double growth. In simple terms, the marital controversy has been shown not only through divorce proceedings, but also through the announcement of divorce to solve the typical situation.
