解构是审视法律及其表层话语的一项分析方法。本文的切入点在于把《法律东方主义》一书置于法律解构的脉络中,质疑法律对立的二元特征。随后,对东方主义与法律这一主题之下的诸多早期作品进行简要的回顾,在增进对非西方法的认识之同时表明东方主义在我们居住的世界仍扮演着重要角色。接着,将检验《法律东方主义》提出的关于中国无法性迷思的诸多主张,并考察该书对美国为何向中国争取治外法权所作的论证。最后,通过考察这部著作中的一个实证面向——美国在华治外法权的实践,来思考东方主义对法学研究的贡献及其在法学研究中的未来。
Deconstruction is an analysis of the law and its superficial discourse. The starting point of this article lies in putting the book “Legal Orientalism” in the context of legal deconstruction and questioning the dual characteristics of legal opposition. Later, a brief review of many early works under the theme of Orientalism and law, while promoting awareness of non-Western law, shows that Orientalism still plays an important role in the world we live in. Next, we will examine many of the claims made by Legal Orientalism about China's illegitimate myth and examine the book's argument on why the United States is seeking extradition for China. Finally, we consider the contribution of Orientalism to the study of law and its future in the study of law by examining an empirical one of the works that is directed at the practice of American foreign affairs outside China.
