后金融危机时代,以欧美为代表的国家拉开金融监督改革序幕,把金融消费者保护做为重头戏。近年来中国举措改革金融,积极鼓励金融创新性发展。本文立足金融创新与金融监管的思考,首先分析中国金融改革在金融危机前后的变化,总结中国金融创新面临的机遇和挑战。然后分析中国金融消费者保护法律制度的构思:制定独立于《消费者权益保护法》的《金融消费者保护法》;构建“2+4”模式;依金融产品等级来保护金融消费者合法权益。
After the financial crisis era, the countries represented by Europe and the United States kicked off the reform of financial supervision and took the financial consumer protection as the main event. In recent years, China has taken measures to reform finance and has actively encouraged innovative financial developments. Based on the thinking of financial innovation and financial regulation, this article first analyzes the changes of China’s financial reform before and after the financial crisis and sums up the opportunities and challenges China’s financial innovation faces. Then it analyzes the conception of legal system of China’s financial consumer protection: formulating the “Consumer Protection Law” independently of the “Consumer Protection Law”; building the “2 + 4” model; protecting financial consumers according to the level of financial products Legal rights and interests.
