随着市场经济的不断成熟与发展,会员卡在消费领域中从产生到发展,日益影响着人们的生活。然而理论及实务中对会员卡的关注甚少,对准入性非预付式会员卡这一特定种类的针对性研究更是凤毛麟角。准入性非预付式会员卡合同性质的明确是解决当事人权利义务及责任分配的前提,本文拟针对其是否具有预约性展开探讨,从而明确其本质属性,并为预约理论的丰富提供实践资料。
With the market economy continues to mature and develop, membership cards in the field of consumption from generation to development, increasingly affect people’s lives. However, little attention has been paid to the membership card in theory and practice, and the particular type of targeted research on the admission non-prepaid membership card is even rarer. The definition of the nature of the contractual non-prepaid membership card is a precondition to solve the rights and obligations of the parties and the distribution of responsibilities. This article intends to explore whether or not it has reservation, so as to clarify its essential attributes and provide practical information for the reservation theory.
