从GATT第19条到WTO《保障措施协议》,作为贸易救济手段的保障措施为世界贸易组织的成员国提供了一项重要的例外条款。保障措施不同于反倾销、反补贴,它是唯一一项针对公平贸易采取限制的救济工具。它具有非歧视性、补偿性等优点,但是在实际援用过程中却暴露出保障措施的若干不合理处。我们在仅基于文献综述的角度窥视保障措施从诞生至今在实践中的问题,并提出解决的建议。
From article 19 of the GATT to the WTO Safeguards Agreement, the safeguard measures as a means of trade remedy provide an important exception to the WTO member states. Safeguard measures are different from anti-dumping and countervailing duties. It is the only relief tool that restricts fair trade. It is non-discriminatory and compensatory. However, some unreasonable safeguards have been exposed in the process of actual assistance. We peeked at the issue of the practical application of safeguards from the moment of their birth to today based on the literature review and put forward suggestions for settlement.
