宪法、行政法、刑法、民法等等都是法律,但是每个法所调整的是不同社会关系,其调整内容与方式完全不同。各部门法的特征、本质、作用、运行和发展规律等,在根本上都是相同的。即:法理学,它专门研究关于法律现象的最基本的共同性大问题。它的研究不是某一国的法律制度,也不研究某一种法或者法律现象,而是把法律作为一个整体,来研究其产生、本质、发展规律、创制、实施和作用等一般性理论问题。本文对法律的概念及内容,做如下理论浅析。
Constitution, administrative law, criminal law, civil law, etc. are all laws, but each law is adjusted to different social relations, the content and manner of its adjustment is completely different. The characteristics, essences, functions, operation and development rules of the various departmental laws are fundamentally the same. Namely: jurisprudence, which specializes in the most fundamental commonalities on the phenomenon of law. Its research is not a legal system of a certain country, nor does it study a certain kind of law or legal phenomenon. Instead, it studies law as a whole to study general theoretical issues such as its origin, essence, law of development, creation, implementation and function . This article analyzes the concept and content of law as follows.
