对基于图书馆工作而创作出的作品进行职务作品,或者法人作品的认定具有不同的法律意义。然而,正确区分职务作品与法人作品往往并非易事。图书馆界在就职务作品和法人作品的特征与理论开展探讨的同时,应该注重对范例的分析和研究,从实践中汲取教训,积累经验。图书馆还要采取宣传法律法规、建立和完善制度、引入合同模式、构建激励机制、从事作品价值评估、提高无形资产效益等措施加强对职务作品与法人作品的著作权管理。
It is of different legal significance to carry out job titles of works created based on library work or the identification of legal person works. However, it is often not easy to distinguish between job titles and corporate titles. At the same time of exploring the characteristics and theories of job works and corporate works, the library community should pay attention to analyzing and studying examples, drawing lessons from practice and accumulating experiences. The library should also take measures to promote laws and regulations, establish and perfect the system, introduce the contract mode, construct the incentive mechanism, evaluate the value of the works, and improve the efficiency of the intangible assets. The copyright management of job titles and legal persons works should be strengthened.
