由于起诉程序中控、辩、裁三方构造的缺失,不起诉审查决定过程是非对抗、非诉讼化的。为制约检察机关控诉权力、保障当事人的辩护权利,有必要引入听证制度。同时,在死刑核准、执行、再审申诉等严重缺乏对抗、权力制约不力的程序中宜植入听证环节。目前,应在司法实践的基础上,总结、概括现有各听证程序的共性,借鉴回避、陪审的制度设计,作一体化的制度安排,构建具有普适性的、统一的刑事司法听证程序。匡正诉讼构造是刑事诉讼法修改的逻辑起点。刑事诉讼法修改既是司法改革成果的体现,也是进一步改革的指南。建构听证程序是为了取消它,这是一种渐进式改革的策略,是现有司法改革框架下的权宜之计。
Due to the lack of structures in the prosecution proceedings, defense and arbitration, the decision-making process of non-prosecution review is non-confrontational and non-procedural. In order to restrict the procuratorial organs ’right of complaint and protect the parties’ rights of defense, it is necessary to introduce a hearing system. In the meantime, hearing procedures should be implanted in the process of serious lack of confrontation such as the approval, execution and retrial appeal of death penalty, and ineffective power constraints. At present, we should summarize and generalize the commonalities of the existing hearing procedures on the basis of judicial practice, draw lessons from institutional design of avoidance and jury trials, and make institutional arrangements as an integrated system so as to establish a universal and uniform criminal justice hearing procedure. Corrective Litigation Construction is the Logical Starting Point for the Revision of Criminal Procedure Law. The revision of criminal procedural law is not only an expression of the achievements of judicial reform, but also a guide for further reforms. It is a gradual reform strategy to construct the hearing procedure to cancel it. It is a stop-gap measure under the existing judicial reform.
