《劳动合同法》的颁布实施恰逢长三角、珠三角地区民营中小企业生存的困难时期,发生的倒闭潮、迁移潮引发了各界对该法相关制度的热切关注和激烈争议。而真正导致外资撤离、民营中小企业倒闭迁移的是一系列因素的综合影响所致,因《劳动合同法》导致中小企业的用工成本大幅度增加的事实并没有真正显现过。《劳动合同法》的颁布实施无疑对企业的发展影响广泛而深刻,不过在现阶段,对企业的影响更多的体现为管理理念和制度规范方面,而非实际的用工成本急剧增加。
The promulgation and implementation of the “Labor Contract Law” coincided with the difficult period of the survival of privately-run small and medium-sized enterprises in the Yangtze River Delta and Pearl River Delta regions. The wave of closures and the wave of relocations caused all kinds of enthusiastic concerns and heated controversies over the relevant system of the Law. However, the real impact of the withdrawal of foreign capital and the failure of private SMEs is due to the combination of a series of factors. The fact that the labor contract law has resulted in a substantial increase in SME employment costs has not really emerged. The promulgation and implementation of the Labor Contract Law will undoubtedly have a broad and profound impact on the development of the enterprise. However, at this stage, the impact on the enterprise is more reflected in the management concept and institutional norms rather than the actual increase in labor costs.
