以“有限政府”、“透明度”、“司法审查”、“国民待遇”等核心理念为基石的WTO的规则、体制及价值观根植于“基督教治下的”法律文化,此种文化在基于中国国家利益不受大损的前提下已经在中国法治的各个层面获得了某种程度“成功的入侵”。《手把手地教导中国:GATT究竟为何物》一文以典型的西方主流法律职业文风和尖刻辛辣的语言从某个侧面隐晦地展示了这样的“入侵”。WTO对中国法治影响的实质体现了中西法律文化的对撞,此种对撞在转型期的中国还将长期持续。
The rules, systems and values of WTO based on the core concepts of “limited government”, “transparency”, “judicial review” and “national treatment” are rooted in “under the rule of Christianity” Legal culture that has gained some degree of “successful invasion” at all levels of the Chinese rule of law on the premise of no major loss based on the Chinese national interest. “Hand in hand teaching China: What GATT is” is a vague demonstration of such “invasion” by a typical Western mainstream legal style and spicy language. The essence of WTO’s influence on the rule of law in China reflects the collision of Chinese and Western legal culture. Such a collision of China in the transition period will continue for a long time.
