一、中国劳动法的特征(一)基本定位。在现代中国的劳动法中最重要的是1994年制定并于次年1月1日开始实施的《劳动法》(以下提到《劳动法》原则上指本法)。并不是说以前中国没有有关劳动关系的法律,该法的最大意义在于,它是为适应向社会主义市场经济转型过程中的政治、经济的变化而制定的。这部法律可以说基本具备了现代欧美资本主义诸国的劳动法(也是日本劳动法所继承的)的各项
First, the characteristics of China's labor law (A) the basic orientation. The most important of the labor laws in modern China are the “Labor Law” formulated in 1994 and implemented on January 1 of the following year (the “Labor Law” is referred to in principle hereinafter as the “Labor Law”). It does not mean that China did not have any laws on labor relations in the past. The greatest significance of this law is that it is formulated to meet the political and economic changes in the process of transforming a socialist market economy. This law can be said to basically have all the labor laws of modern European and American capitalist countries (also inherited by Japan's Labor Law)
