南京国民政府在抗战前颁布了民法和土地法,规定了房东对房屋适居性的担保义务、限制租金和退租、准备房屋等措施,以解决当时的房屋问题。抗战爆发后,又颁布了临时性质的房屋租赁条例,以应对当时的“房荒”。尽管在制度设计上存在一些缺陷,在实践中也未能完全贯彻,但南京国民政府对待住宅问题的积极态度应该肯定,其立法上的具体得失也值得今天借鉴。
The Nanjing National Government promulgated the Civil Law and the Land Law before the Anti-Japanese War, stipulating the landlord’s obligation of guaranteeing the habitability of the house, restricting the rent and rent-back, and preparing the houses so as to solve the housing problems at that time. After the outbreak of the war, promulgated a temporary nature of the rental regulations, in response to the then “house shortage ”. Although there are some flaws in the design of the system and are not completely implemented in practice, the positive attitude of the Nanjing National Government to the housing issue should be affirmed. Its concrete legislative gains and losses are worth learning from today.
