质量标准是关于商品质量的内在技术规定。质量标准可通过商标将其内在信息外在表达出来,并传递给消费者。当商标表达质量标准时,商标在发挥着质量保证功能。来自第三方信任的证明商标可以有效表达质量标准,制造商和零售商也往往通过制造商标和销售商标表达质量标准。商标对质量标准的表达关涉相关主体的法律责任配置问题,从保护消费者权益立场出发,商标权人要承担外观主义责任,第三方认证人要承担连带责任。立法完善与司法实践应以保障商标能够真实有效地表达质量标准服务。
Quality standards are the inherent technical requirements for the quality of the product.
