情势变更原则作为一种救济手段,旨在平衡合同当事人之间的利益关系。它的适用有严格的限制条件,会产生变更合同或解除合同的法律后果,且与商业风险有明显的界限。但当前产生的房屋买卖合同纠纷从风险预见、实践操作等方面都与情势变更原则的适用条件不符,因而不宜适用情势变更原则来处理纠纷。对纠纷的解决应更多的考虑商业风险中的风险自负原则,并应针对不同的个案进行处理,以期达到法律效果与社会效果的和谐统一。
The principle of the change of circumstances serves as a relief measure aimed at balancing the interests of the parties involved in the contract. Its application is subject to stringent restrictions that create legal consequences of contract changes or rescission and have clear boundaries with commercial risks. However, the dispute arising from the current contract for the sale and purchase of housing is inconsistent with the applicable conditions of the principle of change of circumstances from the perspective of risk prediction and practical operation. Therefore, the principle of changing circumstances should not be applied to handle disputes. The resolution of disputes should give more consideration to the principle of risk concealment in commercial risks and should deal with different cases in order to achieve the harmonious unity of legal effects and social effects.
