刘晗的文章可以看作是“我们必须追求一种即便政治立法者与实践者都可以认同的宪法理论”主张。作为回应,田雷在《重新发现宪法》一文中,指出目前中国宪法学界对司法化、法院宪法、司法审查的迷思,以及由此导致的宪法学研究逐渐走入了一种“宪法宾语化”的误区;中文语境内的研究者长期以来未能自觉区分constitution与constitutional law这对范畴以及由此所衍生的宪法理论与司法审查理论;文章最后介绍了美国宪法学界重新定义宪法经典的研究趋势,并提倡中国宪法学者努力的方向之一即在于“重新发现(中国)宪法”与“重新定义(中国)宪法经典”。
