食品安全乃世界之共同问题。美国疾病和控制中心最近公布的数据显示,每年大约有四千八百万民美国人(六分之一)罹患食源性疾病,约有十二万八千人住院,还有三千人因此死亡。[1]为此,美国启动了对1938年《联邦食品、药品和化妆品法》(以下简称FDCA)的修改,参众两院在2010年12月22日通过了《食品和药品管理局食品安全现代化法》(以下简称FSMA),于2011年1月4日颁布实施。FSMA建立了一个新的食品安全监管模式,受到了来自消费者、生产者等各方面的广泛支持,被誉为一部历史性的法案。[2]本文将美国食品安全现代化法案各方面特点,呈现于此,希望对我国法律制度的完善有所助益。
Food safety is a common problem in the world. According to recent data released by the Centers for Disease Control and Prevention, about 48 million Americans (one in six) each year suffer from food-borne diseases, with about 128,000 hospitalizations and another 3,000 death. [1] To this end, the United States initiated the amendment to the 1938 Federal Food, Drug and Cosmetic Act (hereinafter referred to as the FDCA), which passed the Food and Drug Administration’s Food Safety Modernization Law "(hereinafter referred to as FSMA), promulgated on January 4, 2011. FSMA has established a new food safety regulatory model, which has received widespread support from consumers, producers and other fields and is honored as a historic act. [2] This article presents all aspects of the U.S. Food Safety Modernization Act, presenting here, hoping to contribute to the improvement of our legal system.
