在本世纪初,国际海上货运的立法工作曾经历了一个黄金时期。特别是《海牙规则》的诞生一度统一了国际海上货运法律,对国际海运的程序化与秩序化作出了贡献。但是半个多世纪以来,随着航运手段的不断进步以及电子通讯技术的日益现代化,加之昔日“规矩”本身存在着种种不完善之处。因而旧的准则已越来越适应不了国际海运不断发展的新形势。继而使来自各方要求对过去的法规进行修订或重新立法的呼声越来越高。目前,国际海事委员会(CMI)正对过去的“统一”规则大动手术。再者,国际上便利海上货运的新做法亦层出不穷。因此,在国际海运法规与实务方面,我们即将看到一个全新的世界。
At the beginning of this century, the legislative work on international maritime trucking had experienced a golden period. In particular, the birth of the Hague Rules once unified the international maritime law of shipping and contributed to the proceduralization and orderliness of international maritime transport. But for more than half a century, with the continuous improvement of shipping means and the increasingly modern electronic communication technology, there are still imperfections in the “rules” itself in the past. As a result, the old norms have increasingly not been able to adapt to the new situation of the continuous development of international shipping. In turn, calls from all parties for the revision or rescission of laws and regulations of the past are getting louder and louder. At present, the International Maritime Committee (CMI) is making major surgeries on the “unified” rules of the past. Moreover, new international practices to facilitate maritime freight transport are also emerging in an endless stream. Therefore, we will soon see a whole new world in terms of international maritime regulations and practices.
