后现代是一种哲学思潮,对教育行业影响颇深。尤其是自从美国学者多特推出后现代课程观理论后,教育行业日益具备了开放性、动态性、多元性等后现代主义特征。刑法是体现实践理性的学科,但在中国刑法学教育中却呈现出课程内容单一,受众和主讲人缺乏互动,过分强调对教材理论无条件服从和机械记忆,研究视角狭促等弊端。因此,在中国刑法教学改革活动中,也应当积极借鉴后现代课程观的合理要素,从而改变中国刑法教育相对封闭,僵化的不利局面。
Postmodernism is a philosophical trend of thought that has a profound impact on the education industry. Especially since the American scholar Dortm launched the concept of postmodern curriculum, the education industry has increasingly possessed the characteristics of postmodernism such as openness, dynamics and pluralism. Criminal law is a discipline which embodies practical rationality. However, in Chinese criminal law education, there is a single course content, lack of interaction between the audience and the presenter, undue emphasis on unconditional subordination of teaching material theory and mechanical memory, short research perspective. Therefore, in the reform of criminal law teaching in China, we should also actively draw lessons from the rational elements of postmodern curriculum concept so as to change the relatively closed and rigid unfavorable situation of Chinese criminal law education.
