《物业管理条例》在立法层面上正式创立了我国的业主委员会制度。《物权法》也进一步规定了业主委员会的相关制度,但是对业主委员会制度的规定都很不具体,存在着业主委员会法律地位没有统一规定、主体资格不明确的缺陷。明确业主委员会的法律地位,是我国建立业主自治与物业管理专业化相结合的管理体制的基础,也是规范物业管理的前提和必然要求。
“Property Management Ordinance” at the legislative level formally established the system of owners of our country. “Property Law” also further stipulates the relevant system of the owners' committee, but the provisions of the owners' committee system are very specific, there is no uniform regulation of the legal status of the owners' committee, the main qualification is not clear shortcomings. To clarify the legal status of the owners' committees is the basis for our country to establish a management system that integrates the ownership of owners and the professionalization of property management. It also serves as a prerequisite and an inevitable requirement for regulating property management.
