卫生许可证是卫生监督机构在企业开业前依据其申请进行预防性卫生监督审查之后,认为符合卫生标准及其他要求而颁发的卫生许可证件。按照《食品卫生法(试行)》第26条之规定,取得卫生许可证是从事食品生产经营的必要条件,这里的“取得”具有特别重要的意义。下面先让我们看一个案例:案情简介:九四年元月三日,某食品经营单位向某市卫生防疫站提出办理食品卫生许可证申请,经检查验收合格,从业人员体检合格。办证时,该单位由于拒交验收费,故此发证人员将已签好的许可证书扣存而未发给该单位。后该单位通过“关系”从工商部门领取了营业执照并开始经营。5月13日,接群众举报市卫生防疫站对其进行检查,以无卫生许可证及经销变质饮料为由决定对该单位予以处罚并开具了行政处罚决定书。该单位不服,遂向市防疫站所在的某区人民法院提起行政诉讼,要求撤销该处罚决定。
Health permit is a health permit issued by the health supervision agency before the establishment of the enterprise according to its application for preventive sanitation supervision and examination and considered as conforming to the hygiene standards and other requirements. Pursuant to Article 26 of the Food Sanitation Law (Trial), obtaining a hygiene permit is a necessary condition for engaging in food production and management.
