法治化的社会事务管理是新时期的特点,宗教事务也不例外。宗教事务法治化具有保障、维护、规范功能。宗教事务法治化着重于宗教事务外部的法治化,内部很大程度上是自主管理、民主管理。我国宗教事务法治化面临传统管理的惯性思维、宗教事务立法不足、宗教事务管理机构不健全和管理事项出现明显漏洞等问题,解决之道是以法治化重构宗教事务法治化理念、制定和完善宗教事务的法律法规、健全和完善宗教事务管理机构等。
The rule of law in the management of social affairs is a characteristic of the new era, and religious affairs are no exception. The legalization of religious affairs has the functions of guaranteeing, safeguarding and standardizing. The legalization of religious affairs focuses on the rule of law outside the religious affairs, largely within its own management and democratic management.
