在明清中西交流过程中,西方的国际法开始了在中国的启蒙之旅。其中标志性的事件有二:西方传教士翻译了西方早期的国际法著作;在西方传教士参与的中俄条约谈判中,国际法得到了运用。这样一个起点值得注意:传教士的桥梁作用;国际法学知识翻译的西述中译方式;国际法输入中国有其外来压力的背景。
During the exchanges between China and the West in the Ming and Qing dynasties, western international law started the journey of enlightenment in China. Among the landmark events are two: Western missionaries translated early works of international law in the West; and international law was applied during the Sino-Russian treaty negotiations involving Western missionaries. Such a starting point deserves our attention: the missionary role of the bridge; the Western approach to the translation of knowledge of international law; and the introduction of international law into China’s context of foreign pressure.
