教学方法、手段的创新和改进是法学教学改革的重点。案例教学法正因符合这一要求而备受法学教育工作者青睐,成为近年来我国法学教学改革的主导方向。在不少法学院系,人们在进行尝试、研究和实践,积累了一些成功的经验,也出版了一定数量的案例汇编或案例教材,形成了法学教育“案例热”。但在“热”的背后,高校法学院系的案例教学法尚没有真正得到推广。现在需要的是冷静的理性思考,以切实找到我国法学案例教学面临的困难和解决的办法:如何形成适合我国法学教育的案例教学方法并在教学中采用?如何编写与案例教学法相适应的案例教材?笔者拟就己之管见,就教于各位学者,以期共同推动我国法学教育和教学的发展。
Teaching methods, means of innovation and improvement of law teaching reform is the focus. Because of this requirement, the case teaching method has been favored by law education workers and has become the dominant direction of law teaching reform in our country in recent years. In many law faculties, people have tried, studied and practiced, accumulated some successful experiences, and also published a certain number of case compilations or case teaching materials to form the legal education “case of hot ”. However, behind the “hot”, the case law pedagogy of college law schools has not really been promoted. What is needed is calm and rational thinking in order to find out the difficulties and solutions to the teaching of jurisprudence in our country: how to form the case teaching method that suits our country’s legal education and how to adopt it in teaching? How to write the case teaching material which is suitable for the case teaching method The author intends to have their own views, teach you scholars, with a view to jointly promote the development of legal education and teaching in our country.
