在中国人民银行颁布《个人住房贷款管理办法》(以下简称《办法》)后,各个商业银行纷纷涉入这一新的业务领域。随着个人商品房市场的日趋发展,以预售商品房作抵押向银行贷款的现象也越来越多,银行贷款的安全性问题也就随之产生。因此这一讲拟对银行在这一新兴的贷款业务中可能遇到的风险和可以采取的法律防范措施进行一个概括的介绍。
After the People’s Bank of China promulgated the “Measures for the Administration of Individual Housing Loans” (hereinafter referred to as the “Measures”), all commercial banks involved in this new business field one after another. With the rapid development of the market for personal commercial housing, the phenomenon of using pre-sold commercial housing to mortgage loans to banks has become more and more, and the safety of bank loans has also arisen. This lecture therefore intends to provide a general overview of the risks that banks may encounter in this emerging lending business and the legal precautions that may be taken.
