法国在法律上不承认同性婚姻,为正面回应同性恋问题,制定了连带民事契约法(PACS法)。PACS法规定同性伴侣签订契约并到法院登记后,即拥有一定的法律地位,双方之间为互助义务,在住房、税收、社保等方面享有优待,关系终止时自行清算。相比较婚姻制度而言,该法的契约色彩明显,存在不完整性,仍很不完备。但该法赋予同性伴侣和异性伴侣相同的婚姻外权利,为同性伴侣进入法的领域提供了制度上的支持。
France legally does not recognize same-sex marriage, in order to respond positively to the issue of homosexuality, enacted a joint civil contract law (PACS Act). After the PACS law stipulates that same-sex couples must sign the contract and register with the court, they have certain legal status, mutual assistance obligations between the two parties, and enjoy preferential treatment in housing, taxation and social security, and liquidate themselves when the relationship is terminated. Compared with the marriage system, the law of the contract color obvious, there is incompleteness, still not perfect. However, this law gives the same marital rights to same-sex couples and heterosexual couples and provides institutional support to the same-sex couples in the field of law.
