雇主拖欠农民工工资的原因是多方面的,渐进式体制转型中刚性的二元结构是其深刻的社会经济背景根源,并直接体现为对农民工歧视等一系列不合理制度安排的后果。本文通过从劳动合同的签订、协调以及强制实施等三个方面不合理的制度安排的分析,探讨了农民工受歧视而遭受工资拖欠的机制。改革现有不合理的制度安排,消除对农民工的社会歧视与排斥,统一和完善城市劳动力市场,建立起由政府、工会和农民工自组织组成的三方维权机制,才能真正根除农民工欠薪这一顽疾。
The reasons for employers' arrears of wages for migrant workers are many. The rigid dual structure during the gradual institutional transition is the root cause of its profound socio-economic background and directly reflects the consequences of a series of unreasonable institutional arrangements on discrimination against migrant workers. Through the analysis of unreasonable institutional arrangements in the three aspects of signing, coordinating and enforcing the labor contract, this paper explores the mechanism of migrant workers being subjected to wage default due to discrimination. Reforming existing unreasonable institutional arrangements, eliminating social discrimination and exclusion of migrant workers, unifying and perfecting the urban labor market, and establishing a tripartite system of safeguarding rights composed of government, trade unions and migrant workers, can we truly eradicate the wage claims of migrant workers This chronic illness.
