建设用地使用权是不动产的重要组成部分,其相关内容系《物权法》规范的重点之一。可以说,土地使用期限届满后土地使用权及地上物如何处置,一直是令立法者头痛不已的难题。人们把希望寄托在《物权法》的制定上,然而《物权法》的规定仍不能让人满意,还存在许多需要解决的问题。本文作者就《物权法》中关于建设用地使用权相关内容,深入探讨了建设用地使用权期限规定的制度缺陷及对策,以期进一步完善建设用地使用权制度。
The right to use construction land is an important part of real estate, and its related content is one of the focuses of the “Property Law” standard. It can be said that how the land use rights and the disposal of land-use materials after the expiration of the land use period have always been a problem for lawmakers. People put their hopes in the “Property Law”, but the “Property Law” is still not satisfactory, there are still many problems to be solved. In this paper, the author discusses the system defects and countermeasures in terms of the term of construction land use rights in the Real Right Law, with a view to further improving the system of the right to use construction land.
