经济社会的进步逐渐发展出了一些特殊的交易形式,如上门推销、信用贷款、分时度假、电子商务等,在这些交易形式下,消费者意思形成自由受到了信息弱势和交涉能力落差的妨碍。法律在这种情况下如何维护消费者的意思形成自由存有漏洞,原因在于没有意识到消费者意思自由形成存在障碍。根据域外立法例,保护消费者意思形成自由应当规定撤回权制度,大陆法系如德国、日本、我国台湾地区皆对消费者合同中的撤回权制
Economic and social progress has gradually developed some special forms of transactions, such as door-to-door marketing, credit loans, timeshare, e-commerce, etc. Under these transactional forms, consumer freedom of formation is hindered by the information weakness and the ability to negotiate . The law in this case how to defend the consumer’s intention to form a free loopholes, because there is no awareness of the existence of consumer freedom of formation obstacles. According to extraterritorial legislation, the right to form a right of withdrawal should be provided for the protection of consumers’ freedom of formation. Civil law systems such as Germany, Japan and Taiwan in China both regulate the right of recall in consumer contracts
