英国政府在殖民地的去殖民化(decolonisaion)(或简称“去殖”)的过程中,人权法(Bill of Rights)往往成为殖民地独立后新宪法不可或缺的条文,一般认为,其目的是保护殖民地少数族裔的权益。但香港人权法的立法经验表明,确保英国政府在撤出殖民地前维持体制稳定,维持社会稳定,才是英国在去殖框架下推动人权法的主要原因。
In the decolonisaion (or “procreation”) of the British colonial government, the Bill of Rights often became an indispensable provision of the new constitution after the colonial independence. It is generally believed that its purpose Is to protect the interests of colonial minorities. However, the legislative experience of Hong Kong’s human rights law shows that ensuring the stability of the British government before its withdrawal from the colonies and maintaining social stability are the two major reasons why Britain has been promoting human rights law within the framework of deconstruction.
