随着经济全球化、一体化的深入,金融领域的交叉和混合经营越来越成为发展的趋势,我国银行保险也呈现快速发展的态势,在我国的保险销售中占有重要的地位。我国目前金融机构是实行分业经营和分业监管,银行与保险还处于合作的初级代理阶段,由于缺乏完善的制度规范、银行保险产品本身也存在风险,特别是信息披露制度和相关投诉制度的不健全,使得金融消费者与银行间的纠纷近年来呈上升趋势。文章介绍并剖析银保合作产品及其存在的问题,从金融消费者权益保护的角度出发,尝试提出相关法律完善建议。
With the deepening of economic globalization and integration, the cross-and mixed management in the financial field has become a trend of development. The bank insurance in our country has also shown a rapid development. It occupies an important position in China’s insurance sales. At present, the financial institutions in our country are separated and supervised separately. Banks and insurance are still in the primary agency stage of cooperation. Due to the lack of perfect rules and regulations, there are risks in the bank insurance products themselves, especially the information disclosure system and related complaints system Not sound, making the dispute between financial consumers and banks is on the rise in recent years. The paper introduces and analyzes the bank-insurance cooperative products and their existing problems. From the perspective of the protection of the rights and interests of the financial consumers, this paper tries to put forward some suggestions on how to perfect the laws.
