【案例】申诉人顾春花系某市邮电局的青年职工。2005年春节期间,邮电局领导安排在农历正月初二、初三夜晚加班两晚,顾春花当即向领导提出:自己已怀孕7个月,需要休息,不便加班。对此,邮电局领导没有同意,并要求申诉人顾春花考虑到春节期间工作忙人手少的问题,克服一下困难,体谅单位的苦衷。顾春花在未获批准的情况下,两晚未到工作岗位,致使电瓶充电间无人上班,邮电局正常的通信业务及生产受到一定的影响。事后,邮电局领导对申诉人顾春花给予了批评教育,并责成其写出书面检查,申诉人顾春花当即加以拒绝,邮电局遂根据《企业职工奖惩条例》第11条第2项规定,以申诉人不服从工作分配为由给予“记过”处分。申诉人顾春花不服,委托律师向劳动仲裁委员会提出仲裁申请,要求被诉人撤销记过处分。
