银行卡及银行自助终端的发明及投入使用,在简化交易程序、提高交易效率、降低交易成本等方面,无疑具有划时代的重大历史意义。然而,随着银行卡的日益普及性使用,相关的可预知或不可预知的现象与问题,亦不断开始出现,并在法律层面上引起越来越多的社会关注。有鉴于此,笔者拟比照《产品质量法》中对产品缺陷之严格责任的规定,提出银行卡技术缺陷这样一个新概念,并由此来探讨银行卡相关案件中各方主体民事责任
The invention and putting into use of bankcards and bank self-service terminals undoubtedly have landmark historical significance in terms of simplifying the transaction procedures, improving transaction efficiency and reducing transaction costs. However, with the increasingly widespread use of bank cards, the related predictable or unpredictable phenomena and problems are beginning to emerge and cause more and more social concern at the legal level. In view of this, I intend to follow the “Product Quality Law” in the strict liability of product defects, proposed a new concept of bank card technology defects, and thus to explore the bank card-related cases, the main body of civil liability
