随着信息技术时代的来临,以电子书网络传播为代表的侵权行为对现有的《著作权法》提出了挑战。相较于传统侵权行为,电子书侵权行为具有多样性、隐蔽性、后果的严重性以及手段的技术性等特征。现行法律关注电子书传播者及其责任的同时忽略了电子书的产生来源问题。侵权电子书的最大来源是信息技术时代的数据安全漏洞,而不是个人行为。在大数据时代,应该加强权利主体的数据安全义务和法律监督,强化互联网服务提供商的审核义务。
With the advent of the information technology era, the infringement represented by the e-book network has challenged the existing Copyright Law. Compared with the traditional infringement, e-book infringement has the characteristics of diversification, concealment, the seriousness of the consequences and the technical means. Current law focuses on e-book communicators and their responsibilities while ignoring the source of e-books. The biggest source of infringing e-books is the data security loopholes in the information technology era, not individual behavior. In the era of big data, data security obligations and legal supervision of rights subjects should be strengthened and the audit obligations of Internet service providers should be strengthened.
