房屋有限产权的出现打破了传统所有权权能的统一,实现了所有权权能的分离。其蕴含的法律内容及存在方式比较切合我国目前住房制度从计划经济下的福利模式向市场经济下的商品模式转轨的实际。但是,在当前有关的法律政策“先夭不足,后天不济”的情况下,伴随着社会发展的进程和住房制度改革的进一步运作,房屋有限产权无论是在理论上还是在实践方面,都将产生一些难以解决的矛盾和问题。本文试图通过对有限产权的性质分析,来探讨房屋有限产权的有关司法处置原则、方法以及法律完善措施。
