刑法学大师冯·李斯特曾言:“刑法是刑事政策不可逾越的藩篱”。日新月异的社会对于刑法的功能提出了新的要求;如何处理刑事政策和刑法的关系,成为了不可回避的问题。对于偏重于体系性思考的刑法理论研究而言,这一问题则被转化为刑事政策和刑法体系的关系问题。德国刑法学家克劳斯·罗克辛教授的代表作《刑事政策与刑法体系》(第二版),以一个全新的视角,言简意赅地阐发了作者对于基础理论问题的看法自德文版问世以来,已经先后被翻译为七种外国文字出版,产生了巨大的学术影响力。
