直销没有固定的营销店铺,这让不少消费者产生后顾之忧。在无店铺销售行为中,广大消费者的正当权益如何得到保障呢?现在,关于直销的立法不仅仅是一个兑现承诺、依法行政的问题,更是一个规范市场秩序、建立市场信用、维护消费者正当权益、促进经济健康发展的问题。对我国政府来说,有关直销立法的担忧与困惑以及敏感的问题较多,除了直销与非法传销的区分、企业的设立条件、税收等问题外,由此折射的还有经济民主化程度等宏观经济政策与理念。而就立法宗旨、立法技术而言,这主要体现在消费者权益保护、法律责任等问题上。为此,北京大学法学院的刘凯湘教授谈出了他近期关于直销立法和消费者权益保护的研究。直销立法中的消费者权益保护是我国直销立法需要确立的指导思想和宗旨之一。实际上,导致几年前政府从容忍传销、给予传销以合法地位到最后视传销为洪水猛兽、“经济邪教”而予以取缔,除了走火入魔的“老鼠会”严重影响经济秩序和社会安定的因素外,主要是由于大量的非法传销欺诈消费者、损害消费者权益进而引起各种纷争以至社会矛盾而造成的。所以,如何把保护消费者权益、防止利用直销损害消费者利益的宗旨体现到中国的直销立法中去,既是衡量中国直销立法水平的关键问题,也是关乎直销立法能否得到立法机关首肯和通过的核心问题。
