在食品生产经营中非法添加是较为常见食品违法行为,“毒包子”、染色馒头、“毒竹笋”等问题层出不穷,是当前我国存在的主要的食品安全问题之一。我国相继出台了《食品安全法》、《刑法修正案(八)》、《关于办理危害食品安全刑事案件适用法律若干问题的解释》、等法律法规,加大对此类违法行为的惩处力度,基本形成了一个打击危害食品安全犯罪,保障人民群众“舌尖上的安全”的法律体系。但是,在具体司法实践中,如何给超范围添加行为定性,明确法律适用方面仍然存在一些问题亟待解决。
Illegal addition of food in the production and operation of the more common food is illegal, “poison buns”, dyed bread, “poisonous bamboo shoots” and other issues one after another, is currently one of the major food safety problems in our country. China has promulgated “Food Safety Law”, “Criminal Law Amendment (8)”, “Interpretation of Several Issues Concerning the Application of Law in Handling Criminal Cases that Endanger Food Safety”, and other laws and regulations, and stepped up efforts to punish such violations. Basically formed a legal system to crack down on crimes that endanger food safety and guarantee people’s “safety on the tongue ”. However, in specific judicial practice, there are still some problems that need to be solved in how to define behavior beyond scope and clarify the application of law.
