当前,我国高等学校法学专业基础课《法理学》的教学中存在重“道”轻“器”、与学生实践能力培养脱节的问题,具体表现为重理论知识灌输而轻法律方法训练、应用性不强、实践教学环节设计不足等,不能满足应用型卓越法律人才培养的需要。为此需重构《法理学》教学理念与内容,“道”“器”并重,在传授法学知识和法治理念的同时,重视法律思维能力和实践能力的培养,实现实践法理学的转向。
