知名商品特有的名称、包装、装潢,是《反不正当竞争法》第五条第(二)项所规范的仿冒行为的对象,是构成该仿冒行为的基本要件之一。在这一要件中,认定知名商品和认定特有的名称、包装、装潢是两个同时存在的难题,但相比之下,知名商品是一个相对的概念,认定知名商品的问题主要在于如何去理解和认识它,特有则是一个具有实质意义的硬性概念,特有的名称、包装、装潢才是这一法定要件的本质东西,因而认定特有的商品名称、包装、装潢对于认定该仿冒行为是否构成更为重要。
