欧洲国家和欧盟法层面上都缺乏“服务”与“服务合同”的统一概念与规则体系。但欧洲各国的服务合同都可以在罗马法中找到共同的历史渊源。面对现实生活中多样的服务类型,欧洲各国以及欧盟立法者基本采用了抽象规则的模式,但是程度各不相同。本文对法国、德国、奥地利等欧陆七国服务合同规则与体系进行国别考察,并对欧盟层面上的服务概念与服务合同立法进行分析,旨在展现欧洲服务合同立法的现状以及发展趋势。
European countries and the EU law at the level of the lack of “service ” and “service contract ” unified concept and rules system. However, all service contracts in European countries can find a common historical origin in Roman law. In the face of various types of services in real life, European countries and EU legislators basically adopt the pattern of abstract rules, but to varying degrees. This article examines the service contract rules and systems of the seven G7 countries in France, Germany and Austria. It also analyzes the service concept and service contract legislation at EU level in order to show the status quo and development trend of the service contract legislation in Europe.
