《中华人民共和国全民所有制工业企业法》(以下简称企业法)以国家基本法的形式规定了职工代表大会是企业实行民主管理的基本形式,是职工行使民主管理的权力机构。《企业法》第五十二条科学地规定了职工代表大会(以下简称职‘代会)的五项职权,即:审议建议权,审议同意权、审议决定权、评议监督权、推荐选举权。《企业法》关于职代会五项职权的规定,是职工民主管理权利的具体化,是职代会行使民主管理权力的基本准则。

The provisions of the “Enterprise Law” on the five powers and responsibilities of the Workers Congress are the concrete embodiment of the rights and interests of democratic management of employees and the basic guideline for the Workers’ Congress to exercise the power of democratic management.
