公益诉讼,是指检察机关以国家法律监督者的身份对涉及国家利益和社会不特定多数人的利益而无人起诉的案件,向法院提起诉讼,要求法院依法判决有关违法行为无效,并追究有关当事人的法律责任的活动。司法实践中已有一些检察机关在提起公益诉讼方面作了一些有益的尝试,取得了明显的效果。但是由于目前我国法制不健全,法律规定不完善,在检察机关对于损害国家和社会公共利益该不该管,能不能提起公诉的问题上,理论界仍有很大争议。随着构建和谐社会的进程的加快,公益诉讼在维护社会利益平衡、解决社会纠纷上日趋重要,现就公益诉讼的起源、理论依据、必要性和可行性及我国公益诉讼的构建作一论述。

With the acceleration of the process of building a harmonious society, public interest litigation is increasingly important in maintaining the balance of social interests and solving social disputes. The author expounds the origin, theoretical basis, necessity and feasibility of public interest litigation and the construction of public interest litigation in our country.
