依据南京国民政府于1948年在南京制定的《公务人员任用法》、1985年台湾地区制定的《教育人员任用条例》、1995年台湾地区颁布的《教师法》及这些法律文本的修正条款为原始资料,探讨不同历史背景之下,政府处理“不适任教师”的做法及特点。研究发现,台湾地区70年来处理“不适任教师”法制化过程分为道德规范、行政规范、法律规范等3个时期。法律规范时期分为初期阶段、确立阶段及逐步完善阶段。其中的主导力量是政治与社会变迁带动下,学生受教育权与教师工作权两股势力之间的折冲协商。有关“不适任教师”的条文立法及修正显示了一段教师与学生权力关系演变的历史面貌。
According to the “Civil Servant Appointment Law” formulated by the Nanjing National Government in Nanjing in 1948, the “Regulations on the Appointment of Educational Employees” enacted in Taiwan in 1985, the “Teacher Law” promulgated in Taiwan in 1995, and the amended clauses of these legal texts, Data to explore the different historical background, the government to deal with “inappropriate teacher ” practices and characteristics. Legislation and amendments to the articles on “incompetent teachers” show the history of the evolution of the relationship between teachers and students.
