2009年3月4日,国际刑事法院预审分庭批准了对苏丹现任总统巴希尔的逮捕令,这一举动使国际社会自2005年3月安理会提交情势以来,对于达尔富尔情势的关注再次升温。各界对此都表示了担忧,两种看似对立的声音不绝于耳,即“有正义可能没有和平”与“没有正义就没有持久和平”。文章从理论上分析了司法正义与和平之间的关系以及协调二者关系之方法,进而对巴希尔案件未来进路提出展望。
On March 4, 2009, the Pre-Trial Chamber of the International Criminal Court (ICC) approved the arrest warrant for Sudan’s current President Bashir, a move that has given the international community another concern over the situation in Darfur since the Council submitted the case in March 2005 Warming up All walks of life have expressed concern about this. The two seemingly opposing voices are endless: “There can be no peace with justice” and “There can be no lasting peace without justice.” The article analyzes the relationship between justice and peace and the method of coordinating the relationship between the two in theory, and then puts forward the prospect of the future of Bashir case.
