随着我国社会主义法治建设的不断完善以及我国公民法治意识的不断提高,监督公权力规范行使的呼声日益高涨,在此大背景下,警务投诉机制应运而生。但近年来恶意投诉的频发却给监督制度蒙上了一层阴影,引发了诸多意料之外的负面效应。警务活动中的恶意投诉一方面损害了民警的身心健康,加剧了职业倦怠现象,另一方面影响了民警的执法权威,对整个警务工作造成严重的危害。针对恶意投诉现象发生的原因,应从准确定位警察角色、提高执法水平、加强证据意识、加大对恶意投诉人的惩治力度、加强心理引导以及与媒体和政府其他部分的沟通等方面减少此类问题的发生。
With the continuous improvement of the construction of the socialist legal system in our country and the constant improvement of the awareness of the law-based citizens in our country, there is an increasing demand for supervision over the normative exercise of public power. Against this background, the police complaint mechanism has emerged. However, the frequent occurrence of malicious complaints in recent years has cast a shadow over the supervisory system and triggered many unexpected negative effects. Malicious complaints in police activities have harmed the physical and mental health of police officers, exacerbated the phenomenon of job burnout and, on the other hand, affected the law enforcement authority of the police and seriously jeopardized the entire police work. For the reasons of malicious complaints, such problems should be reduced from accurately locating the role of police, raising the level of law enforcement, strengthening the awareness of evidence, increasing the punishment of malicious complainants, strengthening psychological guidance and communication with other parts of the media and government happened.
