随着社会经济的发展和收入水平的提高,消费需求增长,法制观念深入人心,消费者保护工作亦越来越受到世界各国的重视。为了更好的使消费者权益争议能够得到切实有效的解决,我国《消费者权益保护法》设定了协商和解、调解、申诉、仲裁、诉讼五种渠道途径。本文通过对我国现有解决消费者权益纠纷的五种途径进行多层次多方面剖析、比较,提出如何维护消费者合法权益的合理方案,并在此基础上提出对我国建立和完善消费者权益保护法律制度的一些合理建议。
With the development of society and economy, the increase of income level, the increase of consumer demand, the concept of legal system enjoys popular support, the protection of consumers is also paid more and more attention by all the countries in the world. In order to better solve the dispute over consumer rights effectively, China’s “Consumer Protection Law” sets five channels for reconciliation, mediation, appeal, arbitration and litigation. This article analyzes and compares the five ways to solve the disputes over the rights and interests of consumers in our country at present, and puts forward some reasonable solutions to how to safeguard the legitimate rights and interests of consumers. Based on this, it puts forward some suggestions to establish and improve the protection of consumers’ rights and interests Legal system of some reasonable suggestions.
