采用文献资料、逻辑分析等研究方法,对奥运会参赛运动员所享有的主要权利进行了厘清。分析体育权利、奥林匹克运动的纲领性文件《奥林匹克宪章》(2014)以及《体育运动国际宪章》等国际体育规章的基础上,对奥运会参赛运动员的平等和不受歧视权、身体健康权、公平竞争权、教育权与职业保障权、建议权进行了较为详细的阐述,并从奥林匹克运动中的年龄限制、裁判行为、金牌追求的“异化”行为、经济与合同行为4个方面探讨了奥林匹克实践中侵害运动员权利的现象,并提出了通过修订相关规范性文件明确运动员的基本权利、采用先进的技术性设备和严密的程序保证裁判工作的公平与公正、进一步落实“运动员职业发展计划”中的核心要旨、建立完善的利益协调机制保障运动员权利的建议。
