在当前情况下,土地市场还不完善,法律规定国有建设用地使用权可以自由流转,但对集体所有的建设用地使用权流转的限制较多。但在实际情况中,集体所有建设用地使用权流转除法定几种方式外,普遍存在隐形市场的其他流转方式。本文运用理论与实证相结合的方法,从法律角度探讨隐形市场中的流转方式,并分析其特点,最后提出对集体土地建设用地使用权流转的相关建议。
Under the current circumstances, the land market is still not perfect. The law stipulates that the right to use state-owned land for construction may be freely circulated, but there are more restrictions on the circulation of the right to use collective-owned construction land. However, in practice, except for the statutory methods of circulation of the right of use of collectively owned construction land, there are other modes of transfer of invisible markets. This article uses a combination of theoretical and empirical methods to explore the method of circulation in the invisible market from a legal point of view, and analyzes its characteristics. Finally, it puts forward some suggestions on the transfer of the right to use the land for construction of collective land.
